Rule 4. Summons

(a) Contents; Amendments.

(1) Contents. A summons must:

(A) name the court and the parties;

(B) be directed to the defendant;

(C) state the name and address of the plaintiff's attorney or—ifunrepresented—of the plaintiff;

(D) state the time within which the defendant must appear anddefend;

(E) notify the defendant that a failure to appear and defendwill result in a default judgment against the defendant for the relief demandedin the complaint;

(F) be signed by the clerk; and

(G) bear the court's seal.

(2) Amendments. The court may permit a summons to be amended.

(a) 內(nèi)容；修改

(1) 內(nèi)容,。傳票必須：

(A) 載明法院名稱和當(dāng)事人姓名/名稱,；

(B) 指明送達(dá)給被告；

(C) 載明原告律師的姓名及地址,，或者在原告未委托代理人時(shí),，載明原告姓名/名稱及地址；

(D) 載明被告出庭和答辯期限,；

(E) 告知被告如不出庭答辯,，法院將會就原告起訴書中載明的訴訟請求做出缺席判決；

(F) 由書記員簽發(fā),；并且

(G) 加蓋法院公章,；

(2) 修改。法院可以準(zhǔn)許對傳票做出修改,。

(b) Issuance. On or afterfiling the complaint, the plaintiff may present a summons to the clerk forsignature and seal. If the summons is properly completed, the clerk must sign,seal, and issue it to the plaintiff for service on the defendant. A summons—ora copy of a summons that is addressed to multiple defendants—must be issued foreach defendant to be served.

(b) 簽發(fā),。在遞交起訴狀時(shí)，或者在遞交起訴狀之后,，原告即可向法庭書記員呈遞傳票,，請求書記員簽字并蓋章。如果傳票填寫完整,、適當(dāng),，書記員必須簽字和蓋章,，并應(yīng)簽發(fā)給原告，由原告負(fù)責(zé)向被告送達(dá),。有多個(gè)被告時(shí),，傳票必須針對擬被送達(dá)的被告逐一簽發(fā)。

(c) Service.

(1) In General. A summons mustbe served with a copy of the complaint. The plaintiff is responsible for havingthe summons and complaint served within the time allowed by Rule 4(m) and mustfurnish the necessary copies to the person who makes service.

(2) By Whom. Any person whois at least 18 years old and not a party may serve a summons and complaint.

(3) By a Marshal or SomeoneSpecially Appointed. At the plaintiff's request, the court may order thatservice be made by a United States marshal or deputy marshal or by a personspecially appointed by the court. The court must so order if the plaintiff isauthorized to proceed in forma pauperis under 28 U.S.C. §1915 or as a seamanunder 28 U.S.C. §1916.

(c) 送達(dá)

(1) 一般規(guī)定,。送達(dá)傳票必須隨附起訴書副本一份。原告負(fù)責(zé)在本《規(guī)則》第四條第M款規(guī)定的期限內(nèi)將傳票及起訴書送達(dá)給被告,，并須向執(zhí)行送達(dá)服務(wù)之人提供必要副本,。

(2) 送達(dá)事項(xiàng)執(zhí)行人。非一方當(dāng)事人且年滿十八歲的任何人均可執(zhí)行傳票和起訴書送達(dá)事項(xiàng),。

(3) 通過執(zhí)法官或者專門指定的人員送達(dá),。應(yīng)原告請求，法院可以指令聯(lián)邦執(zhí)法官,、執(zhí)法次官或者專門指定的人員負(fù)責(zé)執(zhí)行上述送達(dá)事項(xiàng),。如果原告屬于《美國法典》第二十八編第1915條規(guī)定的享受貧民訴訟資格（IFP）之人，或者是《美國法典》第二十八編第1916條規(guī)定的海員,，則法院必須做出上述送達(dá)指令,。
